This Privacy Policy describes how Bynder manages your privacy, including the ways in which we may contact you and our use of cookies; it forms a part of our Website Terms of Use, iOS App Terms of Use, Android App Terms of Use, Trial Terms of Use and Orbit B2B Terms of Service. Bynder knows that as visitors to our website (“the Website”) and users of a Bynder trial or free version, including Orbit (“Services”), you care about how your personal and organizational information is collected, used, disclosed, transferred, stored, and shared. Bynder goes to great lengths to protect your information and your privacy.

Please familiarize yourself with this Privacy Policy. 1. Acceptance of Terms

In order to request and use the Services, you need to provide your name and email address to us. Any Personal Information that is submitted or collected during your use of the Services will be subject to this Privacy Policy. Your use of the Services will also be subject to the Bynder Acceptable Use Policy and the Trial Terms of Use or the First in Orbit Terms of Use, as relevant.

By visiting the Website or using the Services in any manner, you acknowledge that you fully accept the practices and policies outlined here, and you consent to our collection, use, and transfer of your information in the following ways. If you do not accept the Privacy Policy as a whole you must immediately stop using the Website and Services.

2. What We Collect & How We Use It

2.1 Websites

When you visit the Website, you are not required to provide any personal information. However, when you contact us via the chat function in the Website, when you sign up to receive information from us, or when you sign up to receive and use the Services, you are required to provide some Personal Information about yourself, and we may collect some Navigational Information, in accordance with our Cookies Policy below.

“Personal Information” refers to any information that you choose to submit to us that identifies you personally. Acceptance of these service provider terms is required to access the Website and Services. Further information is set out below in our Cookies Policy.

Bynder seeks to conclude data processing agreements with each service provider before third party services are implemented into the Website or Services in order to ensure that your Personal Information is used, stored, and transferred securely and in accordance with European Union law. Even so, Bynder does not control or assume any responsibility for the content or practices of these service providers, including their data storage and transfer policies, and this Privacy Policy does not apply to these features, which are governed by their own policies and terms.

2.5 External Websites

The Website and Services may contain links to other websites run by third parties. Our provision of these links does not amount to our endorsement of these other websites, nor their content, owners, or practices. This Privacy Policy does not apply to those other websites, which are governed by their own terms and policies. Bynder does not control or assume any responsibility for the content or practices of these other websites.

2.6 Customer Testimonials & Quotes

We may publish customer testimonials and quotes on the Website, which may contain some Personal Information. Bynder obtains consent from each customer and the featured individual prior to posting their name and testimonial.

2.7 Information of Minors

The Website and Services are not intended for or targeted toward children under 18 (“Minors”), and we do not knowingly collect any information about Minors. If you believe that we have collected information about Minors, please contact us at [email protected] so that we can delete the information.

2.8 We Don’t Sell Personal Information

We will never sell your Personal Information to a third party, we promise.

3. Retention & Security of Personal Information

3.1 Retention of Personal Information

We retain any Personal Information that you provide to us so long as we consider it to be necessary, after which time we will securely delete the information. We will also delete any of your Personal Information from our servers upon your request, as detailed in Bynder’s Opt-Out & Anti-Spam Policy below.

3.2 Security of Personal Information

As part of being ISO 27001:2013 certified, we use a range of security technologies and processes to protect your Personal Information from unauthorized access, use, and disclosure. Our servers are housed in secure and controlled environments administered by Amazon Web Services (AWS), which are protected from unauthorized access as per the AWS Cloud Security policy: aws.amazon.com/security/. Personal Information is encrypted when it is collected via the Website and Services and/or is transmitted to third parties in accordance with this Privacy Policy.

3.3 Transfer of Personal Information

Bynder is compliant with European Union law and maintains strong data protection and privacy controls to protect your Personal Information and ensure its security during international transfer and any periods of storage in foreign locations. As an international company, we may transfer and access Personal Information from around the world, including between and from within the European Union and the United States. No matter where you or your data are located, this Privacy Policy shall apply, even if we transfer Personal Information to other countries.

3.4 Disclosure of your Personal Information

We reserve the right to use or disclose your Personal Information if we are required by law or if we reasonably determine that use or disclosure of your Personal Information is necessary to protect our rights, operations, or users; comply with a law, court order, or legal process; or perform our contractual obligations.
