Bynder knows that as visitors to our website (“the Website”) or users of a Bynder trial version (“Bynder Trial”), you care about how your personal or organizational information is collected, used, disclosed, transferred, stored and shared. Bynder goes to great lengths to protect your information and your privacy. We may update this policy occasionally. We will handle information in accordance with the Privacy Policy in effect at the time we gather that information.

1. Acceptance of Terms

By visiting or using the Website or Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you consent to our collection, use, and sharing of your information in the following ways. By using the Website or Bynder Trial, you indicate that you fully accept the Privacy Policy. If you do not accept the Privacy Policy, you must immediately stop using the Website or Bynder Trial.

2. What We Collect & How We Use It

2.1 Websites

When you visit the Website, you are not required to provide any personal information. But, when you contact us via the chat function in the Website, when you sign up to receive information from us, or when you sign up to receive a trial version of Bynder, you are required to provide some Personal Information about yourself, and we also collect some Navigational Information, in accordance with our Cookies Policy.

2.2 Personal Information

“Personal Information” refers to any information that you choose to submit to us that identifies you personally. This includes, for example, your name, email address, company name, address, phone number and other information about you and/or your business. This can also include information about you that is publically available or information that is available about you online via sites like Facebook, LinkedIn, Twitter and Google.

This refers to information about your computer, device, and visits to the Website, including your IP address, geographical location, browser type, referral source, length of visit and pages viewed. As such, Navigation Information may include Personal Information. 2.4 Service Providers

The Website integrates some services provided by third parties. This means that we may need to share some of your information with them in order for these services to work, including removing repetitive information from prospect lists, analyzing data, providing marketing assistance, and providing customer service. As such, the terms and conditions of these third parties may apply to you as well, notably: Google Analytics, Hubspot, Intercom, Optimizely and Zendesk. Further information is set out below in our Cookies Policy and the Trial Terms of Use. Please note that in order to use Google Analytics, the Website Bynder has signed a processing agreement with Google, in accordance with which it uses cookies, has chosen to mask the last octet of your IP address, has turned off 'data sharing', and does not use other Google services in conjunction with Google Analytics. If you want to post a public comment on the Bynder blog section of the Website, you are asked to provide your first name and email address, which are stored in accordance with Hubspot’s terms and conditions.

The Website includes a chat feature, which enables you to communicate directly with one of our personnel. The chat feature is provided by a third party service provider, and if you use the chat feature, you also agree to their terms of service for the control, storage, and transfer of your data, for which Bynder assumes no responsibility.

2.5 Customer Testimonials & Quotes

We may publish customer testimonials and quotes on the Website, which may contain some Personal Information. Bynder obtains consent from each customer and the featured individual prior to posting their name and testimonial.

2.6 External Websites

The Website may contain links to other websites run by third parties. Bynder does not control, or assume any responsibility for, the content or practices of these other websites. Our provision of these links does not amount to our endorsement of these other websites, nor their content, owners or practices. This Privacy Policy does not apply to those other websites, which are governed by their own terms and policies.

2.7 Trials

In order to request a trial version of Bynder, you need to provider your name and email address through the Website. Any Personal Information about you that is submitted or collected during your use of a trial version of Bynder will be subject to this Privacy Policy. Your use of a trial version of Bynder will also be subject to the Bynder Trial Terms of Use.

2.8 Information of Minors

The Website is not intended for or targeted at children under 18 (“Minors”), and we do not knowingly collect any information about Minors. If you believe that we have collected information about Minors, please contact us at [email protected] so that we can delete the information.

3. Retention & Security of Personal Information

3.1 Retention of Personal Information

We retain any Personal Information that you provide to us so long as we consider it to be relevant or necessary, after which time we securely delete the information. We will also delete any of your Personal Information from our servers upon your request, as detailed in Bynder’s Opt-Out & Anti-Spam Policy below.

3.2 Security of Personal Information

As part of being ISO 27001 certified, we use a range of security technologies and processes to protect your Personal Information from unauthorized access, use or disclosure. Our servers are housed in secure and controlled environments, which are protected from unauthorized access. Sensitive Personal Information (such as your name and geographical location) is encrypted when it is collected via the Website and/or is transmitted to third party websites.

3.3 Transfer of Personal Information

As an international company, we may transfer and access Personal Information from around the world, including the European Union and the United States. No matter where you are located, this Privacy Policy shall apply, even if we transfer Personal Information to other countries. Bynder is compliant with European Union law and maintains strong data protection and privacy controls to protect your Personal Information and ensure its security during international transfer and any periods of storage in foreign locations.

3.4 Disclosure of your Personal Information

If we are required by law or if we reasonably believe that use or disclosure of your Personal Information is necessary either to protect our rights or to comply with a law, court order or legal process, we reserve the right to use of disclose your Personal Information.

We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users.
